By accessing or using Acaption ("the Service") at acaption.com, you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service. The Service is operated by a sole trader registered in Spain.
You must be at least 18 years of age to use the Service. By using the Service you represent and warrant that you are 18 or older. The Service is intended exclusively for professional adult content creators and agencies. We reserve the right to request age verification at any time and to suspend accounts where eligibility cannot be confirmed.
Acaption is a software-as-a-service (SaaS) application that generates AI-powered captions for adult content images and videos uploaded by the user. The Service processes files temporarily for caption generation purposes only. No files are stored permanently on our servers.
The Service is offered on the following monthly subscription plans:
Subscriptions are billed monthly in advance. Your subscription renews automatically on the same day each month unless cancelled. All prices are in Euros and inclusive of applicable VAT where required by law.
Payment is processed by a third-party payment processor. By subscribing you authorise recurring charges to your payment method for the applicable subscription fee.
You may cancel your subscription at any time via your account dashboard or by contacting us at hello@acaption.com. Cancellation takes effect at the end of the current billing period. You retain access to the Service until the end of your paid period. No partial refunds are issued for unused time within a billing period.
We offer a refund on your first payment only if requested within 7 days of the initial charge and you have made fewer than 10 caption generation requests. After this window, or after the first billing period, no refunds are issued. Refund requests must be submitted to hello@acaption.com with your account email and reason for the request.
Chargebacks filed without first contacting us will result in immediate account suspension and may be disputed.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
We reserve the right to suspend or terminate accounts that violate these terms without notice and without refund.
The following categories of content are strictly prohibited and constitute grounds for immediate account termination, reporting to relevant authorities, and legal action where applicable. You must not upload, process, or seek to generate captions for any material that:
Acaption operates automated prohibited-content detection at multiple levels of the caption generation pipeline. Attempts to circumvent these controls will result in permanent account suspension and may be reported to law enforcement.
If you encounter content on the platform that you believe violates these prohibitions, please report it immediately to hello@acaption.com.
You retain all rights to the files you upload. By uploading files you grant us a temporary, limited licence to process them solely for the purpose of generating captions. Captions generated by the Service are provided to you for your use without restriction.
The Service, its code, design, and branding are the intellectual property of the operator and may not be copied or reproduced.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that captions generated will meet your requirements. AI-generated output may contain errors or inaccuracies.
To the maximum extent permitted by law, the operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the 30 days preceding the claim.
These Terms are governed by the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of Spain.
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify active subscribers of material changes by email.
